You waive the right to receive specific notice of such changes, and continued use of the website signifies your acceptance of those changes. If you do not agree with these Terms, please stop using the website immediately. We encourage you to frequently review these Terms to ensure that you understand the terms and conditions applicable to your access to and use of the Service. These Terms and any additional terms apply to your access to and use of any services provided by us, including but not limited to the website https://www.okminer.com/ (hereinafter referred to as the "Website Service") and our mobile application services ("Mobile Application Services", collectively referred to as the "Service"). Signing other agreements related to our products does not affect the effectiveness of these Terms. If you use the Service on behalf of any organization, you represent and warrant that (a) the organization is a legally established entity in compliance with local laws and regulations, and (b) you have the authority to accept these Terms on behalf of the organization. If you violate these Terms, the organization agrees to be responsible for your actions.
I. Registration and Account
1. Eligibility for Registration
You confirm that, when you complete the registration process or actually use the Service in any other manner permitted by us, you are a natural person, legal person, or other organization with full civil rights capacity and full civil conduct capacity. If you do not possess the aforementioned qualifications, you and your guardian shall bear all consequences resulting therefrom, and we have the right to cancel or permanently freeze your account and claim compensation from you and your guardian.
2. Registration and Account
Upon filling in the information as prompted on the registration page, reading and agreeing to these Terms, and completing the entire registration process, or filling in the information as prompted on the activation page, reading and agreeing to these Terms, and completing the entire activation process, or actually using the Service in any other manner permitted by us, you are bound by these Terms. You may use the email, phone number, or other methods approved by us that you provide or confirm as a means of logging into OKMINER. If the information you provide during registration is inaccurate, we do not bear any responsibility, and you will bear any direct or indirect losses and adverse consequences resulting therefrom.
3. User Information
During the registration or activation process, you must provide accurate information and update it promptly as required by laws and regulations to ensure that it is true, timely, complete, and accurate. If we have reasonable grounds to suspect that the information you provided is incorrect, false, outdated, or incomplete, we have the right to send you inquiries or notifications requesting corrections and have the right to delete the corresponding information directly, suspend, or terminate part or all of the Service provided to you. We do not bear any responsibility, and you will bear any direct or indirect losses and adverse consequences resulting therefrom.
You must accurately fill out and promptly update your provided email address, contact number, contact address, postal code, and other contact information to ensure effective communication between us or other users and you. If we are unable to contact you through these contact methods, resulting in any loss or increased costs during your use of the Service, you shall bear full responsibility. You understand and agree that you have an obligation to maintain the validity of the contact information you provide, and if there are any changes or updates needed, you should follow our requirements to update them.
4. Account Security
You are solely responsible for maintaining the confidentiality of your OKMINER login username and password and for all activities that occur under your login name and password (including but not limited to information disclosure, information posting, online agreement acceptance or submission, online contract renewals, service purchases, and account information settings).
You agree to:
(a) Immediately notify us if you discover any unauthorized use of your OKMINER account and password or any other breach of confidentiality;
(b) Ensure that you strictly comply with the website/service security, authentication, settings, operation mechanisms, or procedures;
(c) Ensure that you exit the website/service correctly at the end of each online session. We are not responsible for any loss resulting from your failure to comply with these provisions. You understand that our response to your requests requires reasonable time, and we do not bear any responsibility for the consequences (including but not limited to any losses incurred by you) before taking action.
II. Service Content
1. Through the OKMINER service and other services provided by us and our affiliates, we offer customers remote blockchain server management, cryptocurrency mining pools, cryptocurrency mining, cloud mining contracts, wallets, cryptocurrency consulting, and other potentially new services and products. You can participate in activities organized by us and use other information services and technical services.
2. You understand and agree that we have the right to provide your user information and operational payment records to government departments (including judicial and administrative departments) upon their request. If you are suspected of infringing on the legal rights of others, we also have the right to provide your necessary identity information to the rights holder if we preliminarily determine that there is suspected infringement.
3. Any taxes and all hardware, software, services, and other costs arising from your use of the Service are solely your responsibility.
III. Service Usage Norms
1. During your use of the Service on OKMINER, you agree to comply with the following commitments: All actions taken while using the Service must comply with national laws, regulations, normative documents, and our rules and requirements, not violate social public interests or public morals, not harm the legal rights of others, not evade taxes, and not violate these Terms and relevant rules. If you violate the aforementioned commitments and cause any legal consequences, you will independently bear all legal responsibilities in your name and ensure that we are free from any loss resulting therefrom. You will not make any commercial use of any data on OKMINER, including but not limited to using any materials displayed on the OKMINER site in any way without our prior written consent, such as copying or distributing. You will not use any device, software, or routine procedure to interfere or attempt to interfere with the normal operation of OKMINER. You will not take any action that results in an unreasonable load on OKMINER's network equipment.
2. You understand and agree that we have the right to unilaterally determine whether you have violated the above commitments and to handle or terminate the service provided to you based on our unilateral determination without needing your consent or prior notification. If a national administrative or judicial authority confirms through an effective legal document that you have committed an illegal or infringing act, or if we determine based on our judgment that your behavior is suspected of violating these Terms or laws and regulations, we have the right to publicly disclose such suspected illegal or breaching behavior and the measures we have taken against you on OKMINER. We have the right to delete any information you publish on OKMINER that is suspected of being illegal, infringing on others' legal rights, or violating these Terms or laws and regulations, without notifying you, and to impose penalties in accordance with relevant regulations. For your actions on OKMINER, including those not performed on OKMINER but affecting OKMINER and its users, we have the right to unilaterally determine the nature of your actions and whether they constitute a violation of this agreement, and to impose corresponding penalties. You should keep all evidence related to your actions and bear any adverse consequences for not being able to provide sufficient evidence. If your suspected violation of the commitments causes damage to any third party, you should independently bear all legal responsibilities in your name and ensure that we are free from any loss or increased costs. If your suspected violation of relevant laws or these Terms causes us any loss, is claimed by any third party, or is punished by any administrative authority, you should compensate us for the resulting losses and/or expenses, including reasonable attorney fees.
IV. User Obligations
1. Users must not use the Service to endanger national security, leak state secrets, infringe on the legal rights of national social collectives and citizens, or use the Service to create, copy, and disseminate the following information:
(1) Inciting resistance or undermining the implementation of the Constitution, laws, and administrative regulations;
(2) Inciting subversion of state power or overthrow of the socialist system;
(3) Inciting secession or undermining national unity;
(4) Inciting ethnic hatred or discrimination, undermining ethnic unity;
(5) Fabricating or distorting facts, spreading rumors, disrupting social order;
(6) Promoting feudal superstitions, obscenity, pornography, gambling, violence, murder, terrorism, or inciting crime;
(7) Publicly insulting others or fabricating facts to slander others, or engaging in other malicious attacks;
(8) Damaging the reputation of state organs;
(9) Other content that violates the Constitution, laws, and administrative regulations;
(10) Conducting commercial advertising activities.
2. Users must not maliciously register OKMINER accounts by any means, including but not limited to registering multiple accounts for profit, speculation, cashing out, or winning prizes. Users must not use other users' accounts without permission. If users violate the above regulations, we have the right to take all necessary measures directly, including but not limited to deleting the content posted by users, suspending or banning user accounts, canceling benefits obtained through violations, and pursuing legal responsibilities through litigation.
3. Users are prohibited from using OKMINER as a place, platform, or medium for engaging in any illegal activities in any form. Without our authorization or permission, users must not engage in any commercial activities in the name of this site, nor use OKMINER as a place, platform, or medium for commercial activities in any form.
V. Service Changes, Interruptions, Terminations, Restrictions, Freezes
1. We may change the service content and may interrupt, suspend, or terminate the service.
2. Upon transfer, we may transfer the relevant assets under this service to a third party; we may also transfer part or all of the services under these Terms to be operated or performed by a third party upon unilateral notice to you. The specific assignee will be subject to our notice.
3. We have the right to interrupt or terminate the service provided to you without notice if any of the following situations occur:
(1) You are required by law to provide true information, but the personal data you provide is not true, or is inconsistent with the registration information and you cannot provide reasonable proof;
(2) You violate relevant laws, regulations, or these Terms;
(3) According to the requirements of laws or competent authorities;
(4) For security reasons or other necessary situations.
4. You can close your account at any time. You still have the obligation to fulfill your responsibilities for any pending transactions. Additionally, you are responsible for any fees incurred before account closure. We may also terminate your account at our discretion by notifying you via email or other methods. If there are suspicions that you have not complied with these Terms, present an unacceptable fraud or management risk to us, or provide false, incomplete, inaccurate, or misleading information, we may suspend your access to the service. We are not responsible for any losses resulting from us closing or suspending your account.
5. For the security of your account and its cryptocurrency, according to these Terms, laws and regulations, legal documents, administrative authorities' requirements, and our judgment of potential risks to your account, we have the right to freeze all or part of the accounts under your name, which means temporarily closing all or part of the permissions to use these accounts. The reverse process of freezing is unfreezing, i.e., we end the freeze on the frozen account. When freezing occurs, if you apply for unfreezing, we have the right to decide whether to allow full or partial unfreezing according to our judgment based on the freezing reasons mentioned above. You should fully understand that the application for unfreezing may not necessarily be allowed, and you should cooperate with our requirements for verifying your identity, including but not limited to providing identity information, ID card, passport, other valid identity documents, and other information or documents required by us.
VI. Privacy Policy
We respect users' privacy. Our privacy policy, provided separately, outlines how we will collect, store, disclose, and use information related to your privacy. You agree to our use of your information according to the terms of the privacy policy.
The user information referred to in these Terms includes information that complies with laws, regulations, and relevant provisions, and meets the following criteria:
(1) Personal information provided by users to OKMINER during registration;
(2) User data automatically received and recorded by OKMINER when users use OKMINER services, participate in website activities, or visit website pages, including but not limited to IP addresses, information in website cookies, and web records requested by users;
(3) Personal information obtained legally from business partners;
(4) Other personal information obtained through legal means.
We promise:
Without legal reasons or user permission, we will not disclose users' passwords, names, phone numbers, and other non-public information to any third party;
In the following legal circumstances, users' personal information will be partially or fully disclosed:
(1) Disclosed to the user or other third parties with the user's consent;
(2) Disclosed to administrative, judicial authorities, or other third parties as required by laws, regulations, or administrative institutions;
(3) Other disclosures as required by laws, regulations, and relevant provisions.
VII. Applicable Law, Jurisdiction, and Others
1. The validity, interpretation, modification, execution, and dispute resolution of these Terms shall be governed by the laws of the Mainland of the People's Republic of China. If there are no relevant legal provisions, general international commercial practices and/or industry practices shall be referred to.
2. These Terms contain the general norms you must follow when using OKMINER. When using OKMINER by logging in to other platforms, you must also comply with the specific norms applicable to that platform (please refer to other agreements you sign with that platform and platform rules). If there is any inconsistency or conflict between the general rules and the specific rules, the specific rules shall take precedence.
